These general terms and conditions are applicable to purchase contracts - purchase of products concluded through the portal located on the web interface www.chocomuseumprague.com

(hereinafter referred to as "we" or "our company").


1.Introductory provisions

1.1 Definitions:
A product refers to services, tickets, vouchers, or coupons offered by the provider through the web interface www.chocomuseumprague.com;
A ticket is a document (or its electronic version) serving as an entry ticket to an event, containing essential information about the event;
A coupon is a document (or its electronic version) serving as a monetary coupon for the provision of services, containing essential information about the coupon's financial value, information about the provider, validity period, unique numerical code, and the method of redemption;
A voucher is a document (or an electronic version of this document) serving as a voucher for the provision of services, containing essential information about the provider's performance, in particular a description of the service ordered or goods purchased, information about the provider, the period of validity of the voucher, a unique numerical code and the manner in which the voucher can be redeemed;
A web interface refers to the web interface of our company located on the website www.chocomuseumprague.com, where the provider offers products;
The purchase price (or simply "price") is the price of goods, tickets, vouchers, or coupons, as indicated alongside each respective product on the web interface;
The Civil Code refers to Act No. 89/2012 Coll., the Civil Code, as amended;
The Terms and Conditions are these General Terms and Conditions;
The Provider refers to the company PPG Group a.s., Husova 241/7, 110 00 Staré Město, Prague, ID: 04346556, VAT ID: CZ04346556, which offers its products through the web interface on its own behalf;
A Contract refers to an agreement concluded between you and the provider, the subject of which is the delivery of a product, upon which you may enter into a contract with the provider for the provision of a service or the sale of goods by the provider.
1.2. Provisions deviating from the terms and conditions may be agreed upon in the purchase contract. Deviating provisions in the purchase contract take precedence over the provisions of the terms and conditions.
1.3. The provisions of the terms and conditions are an integral part of the purchase contract. The purchase contract and the terms and conditions are drawn up exclusively in the Czech language.
1.4. The provider may change or supplement the wording of the terms and conditions. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the terms and conditions.
1.5. The buyer agrees to the terms and conditions set forth below, including the rights regarding defective performance, by ticking the appropriate box when ordering goods on the website. The terms and conditions can be downloaded in a printable format from the web interface and are available for inspection at the provider's premises.


Privacy and Data Protection Statement
2.1. Personal data is secured by the provider according to modern standards, ensuring the maximum possible protection of data processing against unauthorized access or transmission, loss, or destruction, as well as potential misuse.
2.2. Customer personal data is processed in accordance with applicable laws, particularly with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as the GDPR.
2.3. By entering into a contract or purchasing a product, the buyer consents to the processing and collection of their personal data in the provider's database upon successful fulfillment of the contract until the buyer expresses their written objection to this processing. The buyer has the right to access their personal data, the right to rectify them, including other legal rights related to this data. Personal data can be deleted from the database upon a written request from the customer. Customer personal data is fully protected against misuse. The provider does not disclose customer personal data to any other person or entity. Individual contracts are archived by the operator after their conclusion, in electronic form, and are only accessible to the operator of the premises.



Terms of Use of the Product

3.1. Tickets cannot be returned or exchanged after purchase by the customer, but they can be used by a person other than the purchaser.
3.2. Coupons cannot be returned or exchanged after purchase by the customer, but they can be used by a person other than the purchaser.
3.3. Vouchers cannot be returned or exchanged after purchase by the customer, but they can be used by a person other than the purchaser.
3.4. Additional terms of use for products may be specified for individual products in electronic or paper form, and the customer undertakes to comply with them by purchasing the product.
3.5. Products may be delivered in person or electronically.
3.6. Some products have a validity period specified on their documents. After the expiration of this validity period, the customer loses the right to receive the service without entitlement to a refund of the expended financial resources. The provider's obligation expires after the expiration of the product's validity period, and the offer cannot be fulfilled. The provider is not liable for the loss, theft, damage, or destruction of the product.



Terms of Tickets or Vouchers 

4.1. An event is considered to be a tour, lecture, workshop, concert, theatrical performance, or other cultural event held at the Chocolate Art Museum Prague, Husova 241/7, 110 00 Prague, or its premises, and to which admission is subject to payment and according to the rules specified below. Tickets are also sold at the box office of the Chocolate Art Museum Prague, Husova 241/7, 110 00 Prague. Vouchers for gastronomic events (gastronomic experiences) held on fixed dates are also sold in a similar way to tickets and cannot be canceled after purchase .
4.2. Tickets for these events can be purchased online at www.chocomuseumprague.com or in person (offline) at the box office of the Chocolate Art Museum Prague, Husova 241/7, 110 00 Staré Město, Prague.
4.3. Online ticket sales end 10 minutes before the event.
4.4. Offline sales are possible at the venue if capacity permits.
4.5. Online Sales - Purchasing Process, Checking of Tickets


In the form on the website www.chocomuseumprague.com, you enter the desired number of tickets or select specific seats.
You fill in your name and email address, which is necessary for ticket delivery. If the address is entered incorrectly or technical problems occur on the user's side, PPG Group a.s. is not responsible for the non-delivery of these emails.
After clicking the "Pay" button, you will be redirected to the payment gateway, where you can pay the total amount with a credit card (VISA, Mastercard).
After payment, you will be presented with the option to print the tickets. If you do not print them immediately, a link to print will also be sent to your email address. You can print the downloaded tickets at home or wherever you have access to a printer. To facilitate checking, we do not recommend resizing the ticket.
The printed ticket is equipped with a unique barcode or QR code, which will be checked by a reading device upon presentation at the event venue, allowing entry based on this verification.
The visitor may then be marked with an identification bracelet. In this case, it is necessary to wear this identification throughout the event. The ticket cannot be used again after it has been scanned. 
Entry will only be allowed based on the first ticket presented and verified by the reading device. Any subsequent presentation of the ticket or its copy will not be considered, and entry to the event will not be permitted based on them, regardless of who presents it. PPG Group a.s. is not responsible for any difficulties caused by unauthorized copying of this ticket.
Failure to pay for tickets by credit card renders your purchase invalid.

4.7. Offline Sales - Tickets, Checking of Tickets

For in-person (offline) sales, you will receive a ticket for the event after payment.
This ticket will be checked by an authorized person at the venue, allowing entry based on this verification. The visitor may be marked with an identification bracelet. It is necessary to wear this identification throughout the event.
Counterfeiting tickets is unacceptable and punishable by law.


4.8. Ticket Cancellation, Event Cancellation, Adverse Weather Conditions for Outdoor Events

Tickets cannot be canceled or refunded after payment. Tickets can be used by another person than the purchaser (according to the rules for ticket inspection).
If the performance is canceled within 30 minutes of its start, a refund is entitled.
The organizer informs about the date and method of refunding the ticket price no later than three days after the event on the website www.zameckalekarnatrebon.cz and via contact emails provided when purchasing the ticket.
If a tour, lecture, workshop, concert, theatrical performance, or other cultural event is canceled after more than 30 minutes of performance time (net time), no refund is entitled.
Outdoor events take place regardless of weather conditions, provided it is accepted by the performers.
Outdoor events may be interrupted (even repeatedly) and then continued. Appropriate clothing is recommended in case of adverse weather. Umbrellas cannot be used during the performance as they restrict visibility. For this reason, we recommend bringing a waterproof jacket or raincoat.


4.9. Safety

For security reasons, a personal search may be conducted at the entrance to cultural events.
Visitors must adhere to the instructions of the organizers and security personnel.
Weapons, knives, scissors and other objects that could be considered dangerous by the organizer are not allowed on the premises.
The organizer bears no responsibility for damages to property or personal injury.
Consumption of alcohol is prohibited for persons under 18 years of age. Intoxicated individuals who endanger others with their behavior will be escorted out of the premises without refund.
During events, dogs are not allowed into the premises or the area where the event takes place. The only exception is assistance dogs - ZTP, ZTP/P.
TOUR - during the tour it is necessary to follow the instructions of the guide. Touching production equipment and entering restricted area is not permitted. The courtyard floor can be wet and slippery, so personal safety precautions are necessary. PPG Group Inc. does not assume liability for any violations of these rules.


4.10. Photography and Recording at the Event

On a non-professional level, photography and recording are allowed. However, performers may have their own conditions for photography and audio/video recording. Media accreditation is managed by the event organizer.
The organizer and artists reserve the right to photograph, film, video, and television record the concert and the atmosphere of the event. Visitors recorded in the documentation may be further published without further notice or financial compensation. If you do not wish to be photographed or recorded, please inform the event photographer or cameraman directly.
TOUR - Photography is allowed according to the guide's instructions.


Payment for the Product

5.1. The purchase price is specified in the offer of each specific product. The price is always indicated including VAT. The buyer selects the payment method within the order.
5.2. Payment is made through:
Cash at the provider's premises
Online payment cards; during the ordering process, the Buyer enters payment details into the payment gateway displayed at the end of the payment process.

5.3. When using online payment, the product will be delivered electronically to the buyer's email.
5.4. If the product is not delivered to the Buyer, the Buyer should contact the provider at the telephone number +420 608 908 907 to arrange a remedy.
5.5. The provider does not require a deposit or any similar payment from the buyer.
5.6. In the case of cash payment, the purchase price is due upon receipt of the product.
5.7. Any discounts and promotions on products cannot be combined unless expressly stated otherwise.
5.8. If customary in commercial practice or required by generally binding legal regulations, the provider will issue a tax document regarding payments made based on the purchase contract - purchase of products, to the buyer. The provider is not a value-added tax payer. The tax document will be issued by the provider to the buyer after the payment for the goods is settled and will be sent electronically to the buyer's email address.


Delivery of Products

6.1. Ordered products: tickets, vouchers, and coupons, are delivered:
electronically to the buyer's email address
at the provider's premises
6.2 In the case that the method of delivery is agreed upon at the specific request of the purchaser, the purchaser bears the risk and any additional costs associated with this method of delivery.

7. Withdrawal from the Purchase Contract - Purchase of the Product./,./

7.1 The Buyer acknowledges that according to the provisions of § 1837 of the Civil Code, it is not possible to withdraw from the purchase contract - purchase of a product that has been modified according to the request of the Buyer.
7.2 The Buyer acknowledges that the purchase contract cannot be withdrawn from a product such as tickets, coupons and vouchers due to possible misuse in circulation.


Rights Arising from Defective Performance

8.1. The rights and obligations of the contractual parties regarding rights arising from defective performance are governed by the relevant generally binding legal regulations (in particular the provisions of  § 1914 to 1925,  § 2099 to 2117, and  § 2161 to 2174 of the Civil Code).
8.2. The provider is responsible to the buyer for ensuring that the product has the properties agreed upon by the parties, or, in the absence of such an agreement, the properties described by the provider or expected by the buyer considering the nature of the product and based on any advertising conducted by the provider. The product must be suitable for the purpose stated by the provider or for the usual purpose for which such a product is used.
8.3 The rights arising from defective performance shall be exercised by the purchaser at the provider's place of business at which acceptance of the claim is possible in view of the range of the product sold, or at the place of business, as the case may be. The moment the provider receives the buyer's complaint about the product is considered the moment the complaint is made.



Other Rights and Obligations of the Contractual Parties

9.1. The buyer acquires ownership of the product at the moment of full payment of the purchase price.
9.2. The provider is not bound by any codes of conduct in relation to the buyer within the meaning of § 1826 par. 1 letter e) of the Civil Code.
9.3. The provider handles out-of-court consumer complaints through the electronic address husovka@cokomuzeum.cz. Information on the resolution of the buyer's complaint will be sent by the provider to the buyer's electronic address.
9.4. The provider is authorized to sell based on a trade license. Trade supervision is carried out within the scope of its authority by the relevant trade office. Supervision of personal data protection is performed by the Office for Personal Data Protection. The Czech Trade Inspection Authority oversees, among other things, compliance with Act No. 634/1992 Coll., on Consumer Protection, as amended, within the defined scope.
9.5. The buyer hereby assumes the risk of a change in circumstances within the meaning of § 1765 par. 2 of the Civil Code.


10. Sending Commercial Communications and Storing Cookies

10.1. The buyer agrees to the sending of information related to the provider's goods, services, or business to the buyer's electronic address and further agrees to the sending of commercial communications by the provider to the buyer's electronic address.
10.2. The buyer agrees to the storing of so-called cookies on their computer. In the event that it is possible to make a purchase on the website and fulfill the provider's obligations from the purchase agreement without storing cookies on the buyer's computer, the buyer may withdraw their consent as per the previous sentence at any time.



Final Provisions

11.1. If the relationship established by the Purchase Contract - purchase of a product contains an international (foreign) element, the parties agree that the relationship shall be governed by Czech law. This does not affect the consumer's rights arising from generally binding legal regulations.
11.2. If any provision of the terms and conditions is invalid or ineffective, or becomes such, the provision whose meaning is as close as possible to the invalid provision shall replace it. The invalidity or ineffectiveness of one provision does not affect the validity of the other provisions.
11.3 The Purchase Contract - Product Purchase - Ticket including the Terms and Conditions is archived by the Provider in electronic form and is not accessible.

11.5. If you are a consumer and a dispute arises between us from the contract regarding the provision of our services, which we are unable to resolve directly, you have the right to contact the Czech Trade Inspection Authority (address: Czech Trade Inspection Authority, Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2; website: www.coi.cz, www.adr.coi.cz; electronic contact: adr@coi.cz; phone: +420 296 366 360) or the Czech Consumer Association, z. ú. (address: Tř. Karla IV. 430, 500 02 Hradec Králové; website: www.konzument.cz; electronic contact: spotrebitel@regio.cz; phone: +420 495 215 266) for the purpose of out-of-court settlement of a consumer dispute. You can exercise this right no later than 1 year from the date you first asserted the right that is the subject of this consumer dispute with us.
